What is community property?

When determining how to make decisions regarding division of property and debts during divorce, one of the most important steps is determining who owns what. Community property is property that is considered to be owned by both spouses. Under California law, most property that a person has is considered to also be the property of their spouse, including wages, unless it was given as a gift or inheritance. Community property does include debt.
